Terms and Conditions

Check in time is 3:00 pm.est (unless Early Check In has been purchased.)
Check out time is 10:00 am.est (unless Late Check Out has been purchased.)
The properties are professionally cleaned and inspected before and after each rental to ensure that all guests have a clean comfortable stay.
Be thoughtful of renters who may be checking in on the same day that you will be checking out. Occasionally minor delays may occur during peak season.

If you have any emergency you can call the office number and there is an option for after hours emergency.

A $500 security deposit is required to place a reservation.
At that time, you will also include the $60.00 Application Fee.
The balance of your account is due 60 DAYS PRIOR to your scheduled arrival. Unless you have made other arrangements, the SAME payment method you
used to place your reservation will be used to automatically make your final payment 60 days prior to arrival. If we are unable to process your final payment, your home will be offered to other renters until payment is made.  Reservations will not be considered confirmed until Worthington Rentals has received the $500 deposit and $60 application fee and a signed rental agreement. Once this money has been received, whether or not the rental agreement has been completed, the regular cancellation policy applies. (See Cancellation Policy)  If a reservation is made with less than ninety (90) days prior to check-in, the full rental rate is due immediately. The reservation may be canceled without further notice if timely payment is not received by Worthington Rentals by the due date. Final payments are due no later than 90 days prior to arrival. Mark your calendar as NO INVOICE OR REMINDER WILL BE SENT FOR THE FINAL PAYMENT! (See your Confirmation Page for due dates).

Any change or transfer of a confirmed reservation within the same property is subject to a $75.00 Change/Transfer fee and requires property owner approval. Changes from one property to another are subject to our cancellation terms and conditions.

You may request an advanced reservation for the following year for the property you rent. You have first priority to reserve the home you are currently staying in during the same rental time for the following year as long as you fill out and return the Advanced Reservation Request sent to you during your current stay. Advanced requests are subject to an Owner’s return of the property to our program as well as the Owner’s choice of use and rate changes. Remember, if you do not fill out the Advance Reservation Request within the time allotted, the property will become available to others.
Note: Owner Requested Time takes priority. If an owner does not make your time available, we will assist you in finding other accommodations. Rental rates and home amenities may change from year to year.

The Security/Damage/ Utility Deposit shall be returned to the Tenant within forty-five (45) days after the termination of this Lease, after the Landlord has deducted from the deposit all unpaid utility bills (see electric charges), the cost of having the Premises professionally cleaned, together with any damage to the Premises or loss to Landlord as a result of Tenant’s non performance of any of the terms of this Lease. No interest shall be paid to Tenant on the security/damage/utility deposit. Please report any problems or damages observed in the rental property upon check-in OR within 48 hours of check-in. Unreported problems and /or damages are assumed to have occurred during occupancy and guest shall be held responsible for those damages. *

All rates quoted by Worthington Rentals are amounts payable by credit card or check in U.S. funds. Worthington Rentals accepts MasterCard, Visa, or Check.

When paying by credit card, the name of the person mentioned in the reservation, must also be the name that appears on the credit card. Only one card may be used. If you prefer the balance due to be charged to a different card, you must call us prior to your balance due date at 239-437-3334 to make alternative arrangements. If a request to use an alternate credit card is made after your balance due date and we have charged the credit card on file, a 10% service fee will be added to your balance due to cover Reprocessing Fees. No exceptions.
If you are paying by Electronic Check, a non-sufficient funds fee of $50 will apply for any check that is returned unpaid from the bank. The amount of funds and NSF fee must be paid immediately, or Worthington Rentals may cancel reservation.

All cancellations must be in writing and sent by Certified Mail only.
Cancellations more than 90 days prior to your arrival, you will be refunded the entire amount paid toward your reservation less $500 non-refundable cancellation payment and $60 administrative fee.  Cancellations within 90 days prior to your arrival will be subject to the ability to re-rent the unit. There is no guarantee we will be able to re-rent your unit, and there is also no guarantee we will be able to re-rent the unit for the same price you paid. We will provide our best efforts to re-rent. If the property is re-rented, we will issue a refund in the amount we were able to re-rent the property for, less $500 nonrefundable cancellation payment and $60 administrative fee. There will be no refund if the property is not able to be re-rented for the canceled period. If you decide to re-instate your reservation, there will be a $100 re-instatement fee.

The Premises will be occupied only by those person(s) named on the Application to Lease, and Tenant agrees to occupy the premises in compliance with the applicable Declaration of Condominium, Condominium Association By-Laws and the rules and regulations that control the condominium common elements, the Golf Membership and any common areas that Tenant has a right of hereunder, as these restrictive covenants exist or as they may be modified during the Lease term. “Occasional Overnight Guests” are permitted. An “Occasional Overnight Guest” is one who does not stay MORE than 5 nights in any calendar month. Please contact Worthington Realty if this causes a problem. No part of said premises may be sublet nor may this lease be assigned or transferred in any way without consent of the Landlord.

The first day of your arrival, you will receive two keys for the front door.
If lost, replacement keys are available for $50 each. If you become locked out after 5:00 pm, there will be a Key Delivery Fee of $150. A fee of $100 will be deducted from original security deposit to cover the cost of any property keys NOT returned directly to Worthington Realty, Inc., 17901 Summerlin Road, Suite D, Fort Myers, FL 33908. If guests leave without dropping off keys at Worthington Realty Inc., and the keys are not at the unit, guests will be charged a Re-Key Fee of $200. There are no exceptions.

Guests agree NO SMOKING in units, on lanai or porch of property.
Any guest of Worthington Realty, Inc. who, while on the premises illegally possesses or deals in controlled substances, intoxicated, profane, lewd, brawling or disturbs the peace and comfort of other guests or the reputation, dignity or standing of Worthington Realty, Inc., will be evicted from the unit. Failure to leave may result in law enforcement involvement.

Dogs, cats, birds or any other animals are NOT permitted on the premises. If a pet has been discovered to have been in your unit during your stay, a Pet Fee will be charged to your credit card on file. This fee is used for additional cleaning upon departure.Tenant shall not, nor shall Tenant permit any member of Tenant’s household or any person on the premises or the common areas with the consent of the Tenant to bring or keep any dogs, cats, birds or any other animals.Occasionally, a few owners will allow a small non-shedding dog. Please contact a Worthington Realty Rental Agent to discuss options and additional charges.

Tenant accepts said premises in the present condition and agrees to keep the premises in clean and sanitary condition, replace all articles of personal property damaged or broken during the Lease, pay the cost of repairing any damage to part of said premises caused by the negligence of the Tenant or his invitee, and at the termination of Lease, to promptly surrender said premises to Landlord in as good condition as said premises were at the execution of Lease, ordinary wear and tear expected, all at Tenant’s expense.

Landlord shall deliver premises to Tenant in a professionally cleaned condition and agrees to call Rental Agent to plan for Pre-tenant Cleaning at Landlord’s expense.

Upon Tenant’s departure, the property will be professionally cleaned (arranged by Agent) at Tenant’s expense.

Cleaning charges, not to preclude carpet cleaning when necessary, will be determined by the time and amount of cleaning necessary. Any charges for cleaning which exceed the amount collected from Tenant shall be charged against the Security Deposit placed on this property.

Landlord agrees to maintain the property in good condition and repair, provided however, Landlord shall not be required to begin the making of said repairs unless and until Tenant shall have first given notice to Landlord and/or Agent of the nature of said needed repairs. If repairs are due to Tenant’s misuse or negligence Tenant shall be responsible for payment of same, unless repair falls under the scope of normal wear and tear.

After reasonable notice, Tenant shall permit Landlord, his agents and employees to enter the premises at all reasonable times for any purpose connected with repair, improvement, care and management of the premises, including the showing of the residence to prospective tenants or buyers by appointment at the convenience of the Tenant.

Guests are responsible for general cleaning during their stay. Arrangements can be made through Worthington Realty, Inc., where we can put you in touch with one of our cleaning vendors.

In the case of an appliance malfunction, please contact our office and we will arrange for any repairs as quickly as possible.Please do not attempt to repair yourself.

Tenant may not make any alterations or improvements to the Premises without Landlord’s prior approval.

Guests are responsible to place sealed, bagged trash in containers for weekly trash removal. Trash must be sealed and bagged in plastic trash bags and left in designated area in supplied containers. Trash not sealed and placed in plastic bags or in designated areas will result in charges to guests.

For guest’s enjoyment and the enjoyment of others, please respect quiet times between 9:00 pm and 7:00 am.

All units are equipped with high speed WIFI/Internet service.
Worthington Realty will guarantee that your unit will have a functioning WIFI/ Internet connection. We cannot be held responsible if you are unable
to access this service via your own device. No refunds will be given.We suggest you carry a standard Ethernet cable to use should your device be unable to connect via the WIFI connection.

Landlord agrees and acknowledges responsibility to pay up to $75.00 per month of electric charges (with overage to be paid by Tenant)

Landlord agrees and acknowledges to pay for unlimited local telephone service, if applicable. Tenant further acknowledges and agrees that Landlord has the right to install a phone blocking system. Tenant shall be required to charge long distance and directory assistance calls to their home, business or credit card.

Landlord agrees and acknowledges responsibility to pay for water/sewer, trash, lawn and pool maintenance.

Tenant is responsible for payment of propane and/or electricity to heat private swimming pool at the unit, if applicable. Propane tank full upon acceptance, Tenant responsible for refill(s).
  • Cable television is provided by Landlord. (additional cable services such as additional channels, movies, sports, etc. to be paid by tenant)

Landlord agrees to maintain the property in good condition and repair, provided however, Landlord shall not be required to begin the making of said repairs unless and until Tenant shall have first given notice to Landlord and/or Agent of the nature of said needed repairs. If repairs are due to Tenant’s misuse or negligence, Tenant shall be responsible for payment of same, unless repair falls under the scope of normal wear and tear.

Tenant shall pay all cost of proceedings by the Landlord for recovery of rents or for recovery of the possession of the premises, or for the enforcement of any of the terms and conditions of this Lease, including a reasonable attorney’s fee. If the Tenant shall be the prevailing party, Tenant shall be entitled to recover costs and reasonable attorney’s fees.

Should any of the stated payments not be paid when due, then all subsequent payments shall immediately become due and payable.

Tenant covenants and agrees that if default shall be made in the payment of the rent as aforesaid, or if said Tenant shall violate any of the covenants of this lease, then the said Tenant shall become a tenant at sufferance, hereby waiving all right of notice, and the Landlord shall be entitled to immediately re-enter and retake possession of demised premises.

Tenant agrees to hold Landlord harmless from any loss, damage, or claim by third parties from any negligence or intentional conduct by Tenant or those under Tenant’s control.

This lease is conditioned upon approval of Tenant by the association that governs the Premises.

RADON GAS: Radon Gas is a naturally radioactive gas that, when it has accumulated in a building in sufficient quantities, may present health risks to persons who are expose to it over time. Levels of radon that exceed federal and state guidelines have been found in buildings in Florida.

Landlord and Tenant understand that all brokers and real estate associates involved herein will be compensated by the Landlord.

In the event that the above described premises are sold during the period of this Lease, the sale shall in no manner affect the terms and the rights and privileges given Tenants in this Lease, including the right to occupy the premises for the full term of the Lease.

If, during the term of this lease or within 180 days thereafter, the leased Premises is sold by Landlord to Tenant, whereas an Exclusive Right to Sell Contract does not exist, the Landlord will pay Worthington Realty, Inc a 6% commission based upon the gross sales price of the Premises, less any unearned rental commission, at the time of closing.

If the Premises or any part thereof are damaged or destroyed other than by wrongful or negligent acts of Tenant or persons on the Premises with Tenant’s consent as to be unfit for occupancy or use, this Lease shall immediately be terminated, and the Landlord hereby covenants and agrees to return to the Tenant the pro-rated share of the rent for the unexpired term under this Lease, such settlement will then terminate Landlord’s obligation and render this Lease hereinafter null and void.

The singular number will be construed to mean the plural when the execution thereof shall so require.

If any provision of this Lease should be found to be unenforceable, the remaining clauses shall still remain in full force and effect.

SUBORDINATION: This Lease is subordinate to the lien of any mortgage encumbering the fee title to the Premises from time to time.

By providing payment for this rental you hereby acknowledge that you have read and agree to all terms of this agreement. You hereby authorize Worthington Realty, Inc., to charge your credit card for all charges arising from your stay at this property, including but not limited to unpaid rents, damages, lost rents due to damages, lost keys, cable ordered services, excessive utilities or unauthorized pets. All utilities are included unless specified. We also reserve the right to charge the guest credit card on file or deduct from security deposit for any utility costs that exceed seasonal averages.
